Terms of Use

By downloading, installing, or using OmniCam (the "App"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Use ("Terms"). These Terms constitute a binding legal agreement between you ("User") and Malhar Ujawane ("Developer," "we," "us," or "our").

If you are using the App on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use OmniCam on any Apple-branded device that you own or control, solely for your personal or professional creative use, in accordance with Apple's App Store Terms of Service.

This license does not include any right to sublicense, sell, redistribute, or commercially exploit the App itself.

Your download and use of OmniCam is also subject to Apple Inc.'s App Store Terms of Service, which are incorporated herein by reference. In the event of any conflict between these Terms and Apple's App Store Terms, Apple's terms shall govern with respect to the applicable subject matter.

Apple is a third-party beneficiary of these Terms and has the right to enforce them against you.

OmniCam is free to download and includes a fully functional free tier. An optional one-time Pro upgrade is available for $4.99 USD (or the equivalent in your local currency at the time of purchase).

All purchases are processed exclusively by Apple through the App Store. We do not handle, store, or have access to any payment information. All transactions are subject to Apple's payment terms and refund policies.

A single Pro purchase includes Family Sharing — all members of your Apple Family Sharing group receive Pro access at no additional cost.

Pro features are unlocked permanently after a single purchase. There are no recurring charges, subscriptions, or renewal fees.

You may use OmniCam to record, preview, and save video content for personal, educational, journalistic, or commercial creative purposes, provided such use complies with all applicable laws.

You agree not to: (a) copy, modify, adapt, translate, or create derivative works of or based upon the App; (b) reverse engineer, disassemble, decompile, decode, or otherwise attempt to derive or gain access to the source code of the App; (c) sell, sublicense, rent, lease, transfer, assign, or otherwise dispose of the App or any rights therein to any third party; (d) use the App for any unlawful purpose or in violation of any applicable local, state, national, or international law or regulation; (e) record individuals in contexts where consent is legally required without obtaining such consent; (f) remove, obscure, or alter any proprietary notices, labels, or marks on or within the App; (g) use the App in any manner that could damage, disable, overburden, or impair the App or interfere with any other party's use of the App.

OmniCam, including its software, design, code, interface, branding, trademarks, and all related intellectual property, is the exclusive property of Malhar Ujawane and is protected by applicable intellectual property laws. All rights not expressly granted in these Terms are reserved.

Nothing in these Terms grants you any rights to the App's intellectual property beyond the limited license expressly stated herein.

"Apple," "iPhone," "iOS," "iPadOS," "App Store," and related marks are trademarks of Apple Inc., registered in the U.S. and other countries.

Videos and recordings you create using OmniCam are your content. You retain full ownership of and responsibility for all recordings you produce with the App.

The Developer claims no rights, licenses, or ownership over any content you create using OmniCam. You are solely responsible for ensuring that your recordings comply with applicable laws, including privacy laws, consent requirements, and intellectual property rights of third parties.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OMNICAM IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, ACCURACY, AND NON-INFRINGEMENT.

We do not warrant that the App will be error-free, uninterrupted, free of viruses or other harmful components, compatible with any specific iOS version or device, or that defects will be corrected. Your use of the App is at your sole risk.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE DEVELOPER BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, CONSEQUENTIAL, OR PUNITIVE DAMAGES WHATSOEVER, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, LOSS OF GOODWILL, LOSS OF RECORDINGS, BUSINESS INTERRUPTION, OR ANY OTHER COMMERCIAL DAMAGES OR LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE OMNICAM, REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE), EVEN IF THE DEVELOPER HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

In no event shall the Developer's total cumulative liability to you for all claims arising from or related to your use of OmniCam exceed the amount actually paid by you for the App in the twelve (12) months preceding the claim. If you have not made any purchase, the Developer's liability is limited to $1.00 USD.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. In such jurisdictions, our liability is limited to the greatest extent permitted by law.

You agree to indemnify, defend, and hold harmless the Developer and any affiliated persons from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising from: (a) your use of OmniCam; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; or (d) any content you record, create, or distribute using the App.

These Terms are governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. You agree that any dispute arising from or relating to these Terms or your use of OmniCam shall be subject to the exclusive jurisdiction of the courts located in Surat, Gujarat, India.

Notwithstanding the foregoing, the Developer reserves the right to seek injunctive or other equitable relief in any court of competent jurisdiction to prevent unauthorized use or infringement of intellectual property.

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible. The remaining provisions of these Terms shall remain in full force and effect.

These Terms, together with Apple's App Store Terms of Service and our Privacy Policy, constitute the entire agreement between you and the Developer with respect to OmniCam and supersede all prior or contemporaneous communications, representations, and agreements.

We reserve the right to modify these Terms at any time at our sole discretion. Updated Terms will be posted on this page with a revised effective date. Your continued use of OmniCam after such changes are posted constitutes your acceptance of the revised Terms.

If changes are material, we will make reasonable efforts to notify users through the App or App Store update notes.
